Terms Used:
a) Casa Toscana/The Tuscan Sun Import and Travel Inc., 16/A Main Street West, L3M 1R4 Grimsby, Ontario, which operated with Aldershot Travel, Burlington TICO – 50007312 IATA – 67520913.
b) The ‘client’ is the person (or persons) who have made a confirmed booking with Casa Toscana.
1) Booking Acceptance:
1.1 A booking is accepted by Casa Toscana only when we received payment in full. No tickets will be issued until full payment has been received.·
1.2 On receipt of payment, subject to availability and at our discretion, Casa Toscana will reserve the client a place on a trip. A contract is only made between the client and Casa Toscana upon the confirmation of your booking.· Payment of your deposit represents your acceptance of the following terms and conditions:· ·
1.3 Casa Toscana gives notice that services provided in connection with its itineraries, including transportation, hotel accommodations, restaurants, and other services, are purchased from various independent suppliers who are not affiliated with Casa Toscana in any way. Although it endeavours to choose the best suppliers available, Casa Toscana has no right to control their operations and therefore makes these travel arrangements upon the express condition that Casa Toscana , and its own agents and employees, shall not be liable for any delay, mishap, inconvenience, expense, irregularity, bodily injury or death to person, or damage to property occasioned through the conduct or default of any company or individual engaged in providing these services. Each of these passenger conveyance companies, tour companies, hotels, restaurants, etc., is subject to the laws of the state or country where the service is provided.· ·
1.4 Casa Toscana shall not be liable for: (a) expenses such as additional hotel nights and meals not specified in the individual trip itineraries that may be required either en route, prior to, or following a trip, when caused by individual clients’ travel arrangements, by airline scheduling or airline schedule changes, cancelled flights, missed flight connections, or by other factors not under Casa Toscana’s control;expenses incurred in recovering luggage lost by airlines, belongings left behind on a trip, or in shipping purchases or other goods home from abroad;
bodily injury or property damage for any reason, including but not limited to acts of God, weather, quarantines, strikes, civil disturbance, theft, default, detention, annoyance, changes in government regulations, terrorism, war, or failure of conveyance to arrive or depart as scheduled, etc., over which Casa Toscana has no control.
1.5 Casa Toscana reserves the right to take photographic or film records of any of our trips, and may use any such records for promotional and/or commercial purposes with the written consent of the clients.· Casa Toscana reserves the right to substitute hotels from those listed in the itinerary without notice.· Casa Toscana reserves the right to decline to accept or to restrain from further participation any person it judges to be incapable of meeting the rigors and requirements of participating in the activities, or any person whose actions or deportment impede trip operation or the rights, welfare, or enjoyment of other trip members. Not refund is due in any case.·
2) Insurance:
The price of your ticket does not cover your travel insurance.· Casa Toscana strongly recommends that the client purchase comprehensive travel insurance cover for cancellation, medical expenses, personal accident, personal luggage, money and public liability before you travel.
2.1 Casa Toscana reserves the right to refuse admission as a passenger unless the client has arranged appropriate insurance. Casa Toscana accepts no responsibility for loss or personal damage to personal belongings or liability for personal injury/death.· Passengers undertake all activities associated with itinerary at their own risk and are responsible for their own insurance. ·
2.2 Cancellation: Once the tour has been confirmed, no refunds will be made under any circumstances for any unused sectors or sections.·If the reason for a client cancellation is covered by the client insurance policy, the client will be able to make a claim under that policy.·
3) Reservations:
It is the full responsibility of the client to check the accuracy of the dates booked upon receipt of their travel documents.
1.3 Casa Toscana reserves the right to vary, modify or cancel any itinerary, either partly or wholly. Casa Toscana also reserves the right to use alternative vehicles to those advertised.
4) Travelling:
The client must observe the laws and regulations of the countries visited, including customs and foreign exchanges restrictions. ·
4.1 In the interest of safety there may be times when the Casa Toscana’s tour leader has to make a decision. It is a condition of booking that the client must comply with the authority and decisions of the appointed Casa Toscana’s representative. If a client does not comply with the Casa Toscana representative and is not compatible with the general enjoyment and wellbeing of the members of the tour, Casa Toscana reserves the right to exclude the client from continuing the tour. In such a case, Casa Toscana will not be liable for any refund, compensation or any additional costs incurred by the client. Casa Toscana cannot accept responsibility for the behaviour of others on tour nor if any activities are curtailed as a result.· Casa Toscana will be not liable for any inconvenient.·
5) Holiday Details and Conditions:·
Casa Toscana must be advised of any medical conditions, or physical disability requiring special attention when the client makes their booking.· 5.1 The client is responsible for all travel arrangements and costs to/from the point of commencement/conclusion of the tour.· 5.2 It is the responsibility of the client to ensure they have a valid passport and all visa, permits and certificates required for your selected tour, as well as any vaccinations and to comply with all applicable laws.· 5.3 The client agrees that Casa Toscana may take photographs and films of the client while on the tour and that these may be used in Casa Toscana’s brochures and/or advertising without obtaining further consent or payment in respect of such photographs or films.· 5.4 Clients must be aged 18 years and over but Casa Toscana may, at its absolute discretion, and in exceptional circumstances, give confirmation of acceptance of a person outside this age restriction.·
6) Weather Conditions
· Under no circumstances can Casa Toscana be held responsible for weather conditions.·
7) No smoking policy· Casa Toscana operates a no-smoking policy on all its vehicles.
8) General: The booking conditions detailed herein contain the entire contract between the client and Casa Toscana. No representation, term, warranty or condition can be expressed or implied by reference to any other writing, advertisement or conversation. This contact may only be varied in writing by a duly authorised Director of Casa Toscana.·
8.1 All bookings with carriers and other service providers are subject to the terms and conditions and limitations of liability imposed by those carriers and other service providers. Please note that some of these limit or exclude liability in respect of death, personal injury, delay and loss or damage to baggage. Whilst Casa Toscana cannot accept any responsibility for any loss as a result of such actions or as a result of any act of omission of any such third parties, Casa Toscana will give the assistance in helping to resolve any reasonable dispute.·
8.2 Many accommodation arrangements referred to in the brochure or website are provided independently by third party accommodation providers. Such arrangements are subject to the terms and conditions and limitations of liability imposed by those providers, and as such any contracts undertaken directly between you and the third party accommodation provider. All such arrangements are made independently of Casa Toscana, regardless of any help and assistance which Casa Toscana may provide in securing such arrangements.·
8.3 Many activity arrangements referred to in the brochure are provided independently by third party services providers. Such arrangements are subject to the terms and conditions and limitations of liability imposed by those providers, and as such any contracts undertaken directly between you and the third party service provider. All such arrangements are made independently of Casa Toscana, regardless of any help and assistance which Casa Toscana may provide in securing such arrangements.·
8.4 Please note that no airline or carrier depicted or recommended in the brochure by virtue of their endorsement of this brochure represents themselves either as contracting with any legal relationship with any such purchaser.·
8.5 Every effort is made to ensure brochure itinerary accuracy at the time of going to print, however Casa Toscana cannot be held responsible for printing and typographical errors, or errors arising from unforeseen circumstances.
8.6 Validity: These terms and conditions are valid for all reservations made on or after April 10 2010.
